Terms of Service

Welcome to .Takes. By using the app or website (the “Service”) you agree to these Terms. If you don’t agree, don’t use the Service.

Who can use .Takes

You must be at least 13 years old (or the minimum age of digital consent in your country). Voting is anonymous and needs no account. Posting comments or creating takes requires an account. If you use the Service on behalf of an organization, you represent that you’re authorized to accept these Terms for it.

The Service

.Takes lets anyone vote on debatable claims (“takes”) and, with an account, comment and create their own. We’re still building, so features may change, and we may modify, suspend, or discontinue any part of the Service at any time. We don’t guarantee the Service will always be available or error-free.

Your account

Keep your login credentials secure — you’re responsible for activity under your account. Provide accurate information and don’t impersonate anyone or create an account to evade a suspension. You can delete your account at any time from your profile, which permanently removes your account and content.

Your content

You own the takes, comments, and photos you post. By posting, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, reproduce, and distribute that content in connection with operating and promoting the Service. This license ends when you delete the content or your account, except for copies retained in backups or where others have already interacted with it. You’re responsible for what you post and confirm you own it or have the rights to post it — including any photo you upload and the people shown in it.

Acceptable use

Don’t use the Service to post, share, or do anything that:

• is illegal, or promotes or facilitates illegal activity;
• harasses, threatens, defames, or incites violence against anyone;
• is hateful or targets people based on protected characteristics;
• is sexually explicit, or exploits or endangers minors;
• infringes anyone’s intellectual property, privacy, or other rights;
• impersonates a person or organization, or is deliberately misleading;
• is spam, a scam, or manipulates votes, rankings, or metrics;
• contains malware, or attempts to hack, scrape, overload, reverse-engineer, or otherwise interfere with the Service.

Moderation, reporting & enforcement

Anyone can report a take or comment, and signed-in users can block others. We may review, remove, or restrict any content, and suspend or terminate any account, at our discretion — with or without notice — to enforce these Terms or protect the community. We aren’t obligated to host any content, and we’re not responsible for content posted by users.

Advertising

The Service is free and may be supported by advertising. We may display ads and promote takes on and off the platform. Your interactions with advertisers are between you and them.

Our intellectual property

The Service itself — the .Takes name, logo, wordmark, design, and software — is owned by us and protected by intellectual-property laws. These Terms don’t grant you any right to use our branding without our written permission (see our press page for approved logo use).

Third-party services

The Service relies on third parties (for example, hosting, database, analytics, and sign-in providers) and may link to third-party sites. We don’t control and aren’t responsible for third-party services, and your use of them may be governed by their own terms.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Takes, results, and comments reflect users’ opinions, not ours, and we don’t warrant their accuracy.

Limitation of liability

To the maximum extent permitted by law, we won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to USD $100.

Indemnification

You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or the rights of others.

Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your access at any time if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive — including content license, disclaimers, liability limits, and indemnification — survive termination.

Governing law & disputes

These Terms are governed by the laws of the United States and the state in which the operator is based, without regard to conflict-of-laws rules. You agree to resolve disputes in the courts located there, and to first try to resolve any dispute with us informally by contacting us.

Changes

We may update these Terms. If we make material changes, we’ll update the date above and, where appropriate, provide additional notice. Continued use after changes take effect means you accept the updated Terms.
